Notice of Demand to PETRONAS Gas Berhad
The Company wishes to announce that the Company has served a reply to the Notice, to the Solicitor of PBJV Group Sdn Bhd (“PBJV”), a wholly owned subsidiary of Barakah Offshore Berhad, Messrs Dinesh Parveen Nair on 16 October 2019 (“Reply”). In the Reply, the Company states as follows:
1.0 The Company denies all PBJV claims as stated in the Notice therein as baseless allegation and without any merits.
2.0 The Global Settlement Agreement recorded the settlement terms as agreed with PBJV in relation to the following matters:
(a) agreed amount to be paid by PGB for the extension of time for the contract of Pengerang Gas Pipeline Project (“Project”);
(b) agreed amount to be paid by PGB for the change notices;
(c) the balance of the contract price amounting to RM24,483,822.80 which shall not be paid by the Company but to be utilised by the Company to complete all remaining outstanding works under the Project.
3.0 The issuance of the PETRONAS’ License/Registration and any action thereto is at PETRONAS’ sole prerogative.
PGB has further stated in the Reply that in the event PBJV fails and/or refuses to withdraw and retract the frivolous and baseless claims within seven (7) days from the date of the Reply, PGB shall not hesitate to seek legal recourse against PBJV, in which PBJV shall be liable for all such costs and interest.
