Notice to Contractors on MCO

To All PETRONAS Contractors, 

1. Following the statement issued by Istana Negara on 12 January 2021 in relation to the Proclamation of Emergency and the announcement by the YAB Prime Minister of Malaysia on 11 January 2021, to curb and prevent the spread of COVID-19 pandemic in Malaysia. 
2. The Government of Malaysia has on 11 January 2021, decided and ordered the Movement Control Order (“MCO”) for 14 days beginning 13 January 2021 until 26 January 2021 (“MCO Period”), based the following phases:
   • Movement Control Order (“MCO”) on six (6) states: Penang, Selangor, Melaka, Johor, Sabah and the Federal Territories of Kuala Lumpur, Putrajaya and Labuan.
   • Conditional Movement Control Order (“CMCO”) on six (6) states:  Pahang, Perak, Negeri Sembilan, Kedah, Terengganu and Kelantan.
   • Recovery Movement Control Order (“RMCO”) for Perlis and Sarawak, which shall continue throughout the above period.
3. Please take note that activities, operations with regards to oil and gas, petrochemical (including end product) and their relevant ancillaries have been classified as Essential Services under the category of manufacturing and where applicable, under the category of construction with regards to maintenance and critical rectification, whereby the above activities and operations are allowed to operate in ALL states throughout the MCO Period, subject to further details from the authorities. All Contractors shall throughout the MCO Period, comply and ensure the following:
   • Please take note that activities, operations with regards to oil and gas, petrochemical (including end product) and their relevant ancillaries have been classified as Essential Services under the category of manufacturing and where applicable, under the category of construction with regards to maintenance and critical rectification, whereby the above activities and operations are allowed to operate in ALL states throughout the MCO Period, subject to further details from the authorities. All Contractors shall throughout the MCO Period, comply and ensure the following:
     • the Contractors/Employers to download the notification of registration confirmation via *CIMS for the purpose of the movement of their employees during the MCO Period. Contractors must ensure the employees who are allowed to be at work according to the specified times, to bring along a copy of the notification provided by the Employer together with the employee pass / Employer confirmation letter. [Note: *Please refer to (g) and (h) below)]
     • Up to 30 percent of employees in the management group to be in the office. The Contractor shall determine the number of support staff and employees directly involved in the production line by observing strict compliance to the Standard Operating Procedure (SOP). For work that does not require physical attendance, the Contractors are to ensure and observe the Work From Home (WFH) directive.
   • Compliance to all standard operating procedures and guidelines with regards to execution of activities or work, as may be imposed and ordered by the Ministry of International Trade and Industry and other relevant authorities, from time to time;
   • Compliance with all COVID-19 preventive measures as may be ordered by the Ministry of Health, Malaysia from time to time. 
   • Contractors are advised to regularly check and be updated on the guidelines and restrictions by the relevant authorities, affecting or governing the activities (including the employees’ movement), as there could be different requirements and guidelines imposed by the relevant authorities of the respective state(s) and/or district(s). 
   • Health and safety of the personnel are of utmost importance. PETRONAS seeks the cooperation of each Contractor (including sub-contractor) in ensuring the continuity of activities and operations of PETRONAS in a safe manner. Therefore, please take all the necessary precautions as may be appropriate until advised otherwise by the Government of Malaysia.
   • This Notice shall be applicable throughout the MCO Period including any other date as may be ordered by the Government of Malaysia.
   • Contractors that have registered with the MITI database, namely COVID-19 Intelligent Management System (CIMS) through the link https://notification.miti.gov.my need not re-register to operate during the MCO Period. However, all these Contractors are required to download the notification of registration confirmation, beginning 12 January 2021, at 3.00 pm.
   • Contractors that have not registered with CIMS, please attend to such registration via https://notification.miti.gov.my commencing 3.00 pm, 12 January 2021. The notification of registration confirmation can be downloaded by the Contractors upon completion of registration. 
4. Contractors are advised to refer to the MITI website at https://miti.gov.my for further information on the guideline.

Kepada Semua Kontraktor PETRONAS, 

1. Merujuk kepada kenyataan oleh Istana Negara pada 12 Januari 2021 berkenaan Pengisytiharan Darurat dan pengumuman oleh YAB Perdana Menteri Malaysia pada 11 Januari 2021 dalam usaha untuk mengekang penularan pandemik COVID-19 di Malaysia.
2. Kerajaan Malaysia telah mengeluarkan arahan pada 11 Januari 2021 berkenaan dengan Perintah Kawalan Pergerakan (“PKP”) untuk tempoh 14 hari bermula 13 Januari 2021 sehingga 26 Januari 2021 (“Tempoh PKP”) berdasarkan peringkat seperti berikut:
   • PKP ke atas enam (6) negeri: Pulau Pinang, Selangor, Melaka, Johor, Sabah dan Wilayah Persekutuan (Kuala Lumpur, Putrajaya dan Labuan)
   • PKP Bersyarat (“PKPB”) ke atas enam (6) negeri: Pahang, Perak, Negeri Sembilan, Kedah, Terengganu dan Kelantan. 
   • PKP Pemulihan (“PKPP”) ke atas Perlis dan Sarawak, dan akan berterusan untuk Tempoh PKP.
3. Dimaklumkan bahawa aktiviti dan operasi berkenaan minyak dan gas, petrokimia (termasuk produk rantaian) dan perkara berkaitan telah diklasifikasi sebagai Perkhidmatan Perlu di bawah kategori “Pengilangan dan Pembuatan” dan di bawah kategori “Pembinaan” bagi kerja-kerja berkaitan penyelenggaran dan pembaikan  kritikal yang dibenarkan beroperasi sepanjang Tempoh PKP di semua negeri, tertakluk kepada arahan lanjut daripada pihak berkuasa berkenaan. Sepanjang Tempoh PKP, kesemua Kontraktor adalah dikehendaki untuk mematuhi dan memastikan perkara-perkara berikut:
   • pergerakan dan perjalanan pekerja-pekerja Kontraktor mematuhi garis panduan dan sebarang sekatan yang diarahkan oleh pihak berkuasa berkenaan dari masa ke semasa termasuk tetapi tidak terhad kepada:
     • Kontraktor/Majikan hendaklah memuat turun surat notifikasi pengesahan pendaftaran melalui *CIMS bagi tujuan pergerakan pekerja dalam Tempoh PKP. Pekerja Kontraktor yang dibenarkan untuk menjalankan kerja pada masa yang ditetapkan diwajibkan membawa sesalinan surat notifikasi pengesahan pendaftaran yang disediakan oleh Kontraktor/Majikan bersama pas pekerja/surat pengesahan Kontraktor/Majikan. [Nota: *Sila rujuk (g) dan (h) di bawah]
     • Setakat 30 peratus pekerja dalam kumpulan pengurusan dibenarkan berada di pejabat. Pihak Kontraktor akan menentukan jumlah pekerja sokongan dan pekerja-pekerja yang terlibat secara langsung di dalam bahagian pengeluaran (“production line”) dengan memastikan pematuhan ketat Prosedur Operasi Standard (SOP) yang ditetapkan. Bagi kerja-kerja yang tidak memerlukan kehadiran secara fizikal, pihak Kontraktor hendaklah memastikan dan mematuhi arahan Bekerja Dari Rumah (BDR).
   • Pematuhan terhadap SOP dan garis panduan berkenaan perlaksanaan aktiviti atau kerja yang dikeluarkan dan diarahkan oleh Kementerian Perdagangan Antarabangsa & Industri (MITI) dan lain-lain pihak berkuasa berkenaan dari masa ke semasa;
   • Pematuhan terhadap kesemua langkah-langkah pencegahan COVID-19 yang diarahkan oleh Kementerian Kesihatan Malaysia dari masa ke semasa. 
   • Para Kontraktor adalah dinasihatkan untuk sentiasa memeriksa dan mendapatkan maklumat terkini berkenaan garis panduan dan sekatan oleh pihak berkuasa di negeri-negeri dan/atau daerah-daerah berkenaan, yang mempunyai bidang kuasa terhadap aktiviti (termasuk perjalanan pekerja), atas kemungkinan mempunyai keperluan dan garis panduan yang berbeza.
   • Kesihatan dan keselamatan pekerja adalah diutamakan. PETRONAS menghargai kerjasama setiap Kontraktor (termasuk sub-kontraktor) dalam memastikan aktiviti dan operasi PETRONAS dilaksanakan dalam keadaan selamat. Oleh yang demikian, anda hendaklah mengambil semua langkah sewajarnya tertakluk kepada arahan Kerajaan Malaysia. 
   • Notis ini adalah terpakai sepanjang Tempoh (termasuk sebarang tarikh lain yang diarahkan oleh Kerajaan Malaysia).
   • Kontraktor/Syarikat-syarikat yang telah berdaftar dengan pangkalan data MITI iaitu COVID-19 Intelligent Management System (CIMS) melalui pautan https://notification.miti.gov.my tidak perlu membuat pendaftaran semula untuk beroperasi dalam Tempoh PKP. Walaubagaimanapun, Kontraktor/Syarikat-syarikat yang berkenaan  perlu memuat turun surat notifikasi pengesahan pendaftaran mulai 12 Januari 2021 bermula jam 3.00 petang. 
   • Kontraktor/Syarikat-syarikat yang belum berdaftar dengan CIMS diminta untuk membuat pendaftaran melalui pautan https://notification.miti.gov.my mulai pukul 3.00 petang, 12 Januari 2021. Surat notifikasi pengesahan pendaftaran boleh dimuat turun oleh Kontraktor/Syarikat selepas penyempurnaan pendaftaran.
4. Kontraktor dinasihati untuk merujuk kepada laman sesawang MITI https://miti.gov.my untuk keterangan lebih lanjut berkenaan garis panduan.
