Notice on Entry Requirements to PETRONAS' Facilities/Premises

To All PETRONAS Contractors,

1. Reference to the announcement by the Government of Malaysia on 13 August 2021, that manufacturing sector companies listed as essential services in the National Recovery Plan (NRP)’s Phase 1, 2 and 3 areas are allowed to increase the operating capacity based on rate of fully vaccinated workers.  

2. Please take note that activities, operations with regards to oil and gas, petrochemical (including end product) and their relevant ancillaries have been classified as Essential Services under the category of manufacturing and where applicable, under the category of construction with regards to maintenance and critical rectification, whereby the above activities and operations are allowed to operate in ALL states subject and in accordance to instructions or conditions or SOPs including current or effective conditions or any other SOPs as may be issued or ordered by the relevant authorities from time to time.

3. TAKE NOTE that, as a proactive measure to curb the spread of COVID-19 at workplace:  

3.1 In line with the requirement of Malaysia’s COVID-19 National Recovery Plan (NRP), and the instructions by Ministry of International Trade and Industry (MITI) of 15 August 2021, ALL contractors are required to comply and do the following:

• (a) conduct COVID-19 testing as approved by the Ministry of Health, PRIOR to entry or access to any of PETRONAS’ assets, facilities and/or premises.
• (b) conduct periodic & targeted COVID-19 testing as approved by the Ministry of Health through self-testing or at health facilities every two weeks for their employees, throughout the execution of work at PETRONAS’ assets, facilities and/or premises.  

3.2 Below are the direction and guide for the COVID-19 testing, to be observed:  

3.3 PETRONAS will not incur or pay any charges or costs EXCEPT FOR those costs incurred in executing the COVID-19 test under this Paragraph 3.

4.  Effective 1st October 2021, in addition to the pre-entry and periodic COVID-19 testing, ALL or any contractor including its employee(s), management(s), representative(s), agent(s), invitee(s) or sub-contractor (including its employee(s), management(s), representative(s), agent(s), invitee(s)), wishing to enter any PETRONAS’ assets, facilities or premises in Malaysia, MUST be fully vaccinated and is REQUIRED to first furnish upon entry, a valid COVID-19 vaccination certificate.  

5. . A fully vaccinated contractor shall refer to each and all individuals employed and/or authorised by the contractor to undertake the relevant supply or services and shall have been issued with valid certification on complete COVID-19 vaccination, as follows: 

• a) Fourteen (14) days after the second dose in a 2-dose series such as Pfizer, AstraZeneca or Sinovac vaccines; or
• b) Twenty-eight (28) days after a single-dose vaccine, such as Johnson & Johnson’s Janssen or CanSino vaccines; or
• c) Any other vaccines approved by the National Pharmaceutical Regulatory Agency (NPRA) and the corresponding optimum immune response and protection duration.
• d) If applicable, any other booster doses imposed by the Ministry of Health (MOH) Malaysia from time to time; or any other vaccination performed outside the Malaysia as recommended by the World Health Organisation (WHO).

6. TAKE NOTICE that ALL contractors MUST also comply with all the instructions, SOPs, orders, regulations that are issued by the relevant authorities from time to time, including State Government(s), state and/or local authorities with jurisdiction over facilities, premises and/or assets for PETRONAS’ operations in Malaysia.  

7. Current SOPs such as physical distancing, wearing of facemasks and others are mandatory and shall continue to be effective.  

8. Contractors are advised to regularly check, keep themselves abreast and be updated on the guidelines and restrictions by the relevant authorities (including relevant state government(s) state and/or local authorities, affecting or governing the activities including the employees’ movement.  

9. Health and safety of the personnel are of utmost importance. PETRONAS seeks the cooperation of each contractor (including sub-contractor) in ensuring the continuity of activities and operations of PETRONAS in a safe manner. Therefore, please take all the necessary precaution as may be appropriate until advised otherwise by the Government of Malaysia.  

10. This Notice shall be applicable throughout the NRP’s Phase 1,2,3 and 4 period including any other date as may be ordered by the Government of Malaysia.  

11. Notwithstanding item 9 above, PETRONAS shall be entitled to impose or continue to impose any relevant SOPs or conditions prior to entry or during the execution of work at the premise, assets or facilities of PETRONAS, as proactive measure to curb the spread of COVID-19.

Kepada Semua Kontraktor PETRONAS,

1. Merujuk kepada pengumuman oleh Kerajaan Malaysia pada 13 Ogos 2021, bahawa syarikat sektor pembuatan yang disenaraikan sebagai Perkhidmatan Perlu dalam Fasa 1, 2 dan 3 Pelan Pemulihan Nasional (PPN) dibenarkan untuk meningkatkan kapasiti operasi berdasarkan kadar pekerja yang telah menerima vaksinasi lengkap.  

2. Dimaklumkan bahawa aktiviti dan operasi berkenaan minyak dan gas, petrokimia (termasuk produk rantaian) dan perkara berkaitan yang diklasifikasi sebagai Perkhidmatan Perlu di bawah kategori “Pengilangan dan Pembuatan” dan “Pembinaan” bagi kerja-kerja berkaitan penyelenggaraan dan pembaikan kritikal, di mana aktiviti dan operasi di atas dibenarkan beroperasi di SEMUA negeri adalah tertakluk dan menurut arahan atau syarat atau SOP termasuk terma atau syarat atau SOP yang sedang berkuatkuasa atau mana-mana syarat, arahan atau SOP yang dikeluarkan atau diperintahkan oleh pihak berkuasa yang berkenaan dari masa ke semasa.  

3. AMBIL PERHATIAN bahawa, sebagai langkah proaktif untuk mengekang penyebaran COVID-19 di tempat kerja:  

3.1. Selaras dengan kehendak Pelan Pemulihan Nasional (NRP) COVID-19 Malaysia, dan arahan Kementerian Perdagangan Antarabangsa dan Industri (MITI) pada 15 Ogos 2021, SEMUA dan SETIAP kontraktor HENDAKLAH DAN MESTI mematuhi dan melaksanakan perkara berikut:

• (a) menjalani ujian COVID-19 seperti yang diluluskan dan diarahkan oleh Kementerian Kesihatan, SEBELUM dan UNTUK memasuki atau mengakses aset, fasiliti dan/atau premis PETRONAS.
• (b) menjalani ujian COVID-19 seperti yang diluluskan oleh Kementerian Kesihatan melalui ujian kendiri atau di fasiliti kesihatan, setiap dua minggu secara berkala bagi setiap pekerja, sepanjang pelaksanaan kerja di aset, fasiliti dan/atau premis PETRONAS.  

3.2. Berikut adalah arahan dan panduan untuk ujian COVID-19 yang hendaklah dipatuhi:  

3.3. PETRONAS tidak akan membayar atau menanggung apa-apa caj atau kos SELAIN ATAU KECUALI untuk kos yang dibelanjakan atau dikeluarkan dalam melaksanakan ujian COVID-19 di bawah Perenggan 3 ini.

4. Berkuatkuasa mulai 1 Oktober 2021, SEMUA atau MANA-MANA kontraktor termasuk pekerja, pihak pengurusan, wakil, ejen, pelawat/tetamu, sub-kontraktor (termasuk pekerja, pihak pengurusan, wakil, ejen, pelawat/tetamu) yang ingin memasuki mana-mana premis, fasiliti atau aset PETRONAS di Malaysia, HENDAKLAH telah menjalani vaksinasi lengkap dan PERLU mengemukakan sijil vaksinasi COVID-19 yang sah, untuk dan/atau apabila memasuki premis, fasiliti atau asset berkenaan. Keperluan ini hendaklah dilaksanakan berserta dengan ujian COVID-19 pra-syarat kemasukkan dan ujian berkala setiap dua minggu berkenaan.  

5. Kontraktor yang telah menerima vaksinasi lengkap adalah merujuk kepada setiap individu yang bekerja dan/atau diberi kuasa oleh kontraktor untuk melakukan pembekalan atau perkhidmatan yang relevan dan telah mendapat perakuan sah telah menerima vaksinasi COVID-19 lengkap, seperti berikut:  

• a) Empat belas (14) hari selepas dos kedua dalam siri dua (2) dos seperti vaksin Pfizer, AstraZeneca atau Sinovac; atau or
• b) Dua puluh lapan (28) hari selepas vaksin satu dos, seperti vaksin Johnson & Johnson Janssen atau CanSino; atau or
• c) Sebarang vaksin lain yang diluluskan oleh Badan Regulatori Farmasi Negara (NPRA) dan jangka masa tindak balas imunisasi dan perlindungan optimum yang berkenaan.
• d) Jika berkenaan, sebarang dos tambahan lain yang diarahkan oleh Kementerian Kesihatan Malaysia (KKM) dari semasa ke semasa; atau mana-mana vaksinasi lain yang dijalankan di luar Malaysia seperti yang disyorkan oleh Pertubuhan Kesihatan Sedunia (WHO).

6. AMBIL PERHATIAN bahawa SEMUA kontraktor HENDAKLAH juga mematuhi semua dan setiap arahan, SOP, perintah atau peraturan yang dikeluarkan oleh pihak berkuasa berkenaan dari masa ke semasa termasuk Kerajaan Negeri, pihak berkuasa negeri dan/atau tempatan yang mempunyai bidangkuasa ke atas fasiliti, premis dan asset PETRONAS di Malaysia.  

7. Pematuhan SOP semasa seperti penjarakan fizikal, pemakaian pelitup muka dan lain-lain SOP berkenaan, adalah wajib dan berkuasa.  

8. Para Kontraktor adalah dinasihatkan untuk sentiasa memeriksa, mengikuti perkembangan dan mendapatkan maklumat terkini berkenaan sebarang garis panduan, sekatan atau syarat oleh pihak berkuasa termasuk di negeri-negeri dan/atau daerah-daerah yang berkenaan, yang mempunyai bidang kuasa ke atas aktiviti yang berkenaan (termasuk perjalanan serta pergerakan pekerja).  

9. Kesihatan dan keselamatan pekerja adalah diutamakan. PETRONAS menghargai kerjasama setiap Kontraktor (termasuk sub-kontraktor) dalam memastikan aktiviti dan operasi PETRONAS dilaksanakan dalam keadaan selamat. Oleh yang demikian, anda hendaklah mengambil semua langkah sewajarnya tertakluk kepada arahan Kerajaan Malaysia.  

10. Notis ini adalah terpakai sepanjang tempoh Fasa 1,2,3 dan 4 NRP (termasuk sebarang tarikh lain yang diarahkan oleh Kerajaan Malaysia).  

11. Merujuk perkara 9 di atas, PETRONAS berhak untuk mengenakan atau terus mengenakan SOP atau syarat yang relevan sebelum masuk atau semasa pelaksanaan pekerjaan di premis, aset atau kemudahan PETRONAS, sebagai tindakan proaktif untuk mengekang penyebaran COVID-19.
